A criminal investigation or proceeding may, from its earliest stages, affect a company’s governance, the reputation of its executives and the continuity of its operations. In an international and highly regulated economy such as Luxembourg’s, managing criminal law risks is therefore a key concern for businesses and individuals facing potential criminal liability. Our Financial & Criminal Business Law team assists private companies, banking institutions, executives and individuals with the prevention, management and resolution of such situations.
We advise clients at an early stage to identify and prevent criminal law risks, as well as in connection with internal investigations and corrective action plan processes. Once proceedings have been initiated, we assist our clients during searches and seizures and represent them before investigating and trial courts, whether they are acting as civil parties or are themselves under investigation. Our assistance includes assessing the situation, defining the defence strategy and conducting the criminal proceedings.
The initial investigative measures may determine whether relevant evidence is preserved, whether defence rights can be effectively exercised and how the matter subsequently develops. Our team therefore acts promptly and coordinates the criminal defence strategy with any parallel internal investigations, regulatory proceedings or civil actions.
