Dispute Resolution, Chambers & Partners - Department: Band 2
“The team demonstrates strong depth and breadth, with solid expertise and the capacity to address complex disputes effectively.”
Economic relationships depend on the proper performance of contractual obligations and on the ability to obtain compensation where conduct causes loss. Commercial and civil litigation therefore covers disputes arising from the performance, interpretation or termination of business relationships, as well as liability claims. In Luxembourg, the diversity of economic operators and the frequency of cross-border relationships give such disputes an important role in securing commercial dealings. Our General Commercial & Civil Litigation team advises commercial companies, financial institutions, investment funds, shareholders and individuals.
We assist clients at every stage of a dispute, from analysing the situation and assessing the risks to representing them before the Luxembourg courts. Our work includes managing pre-litigation matters, conducting negotiations, preparing procedural documents and handling court proceedings. Where a dispute involves several countries, we also coordinate our work with the relevant foreign counsel to ensure a consistent overall strategy.
Our team acts in both occasional disputes and matters capable of having a lasting impact on our clients’ businesses or commercial relationships. Its experience in commercial and civil litigation enables it to identify the most appropriate legal and procedural tools promptly, while taking into account the economic, reputational and operational implications of each matter. Highly responsive and readily available, it remains closely involved whenever urgency, shifts in the parties’ respective positions or procedural constraints require swift action. Accustomed to complex and cross-border disputes, it develops a coherent strategy from the pre-litigation stage and adapts it as the matter evolves.
