Dispute Resolution, Chambers & Partners - Department: Band 2
“The team demonstrates strong depth and breadth, with solid expertise and the capacity to address complex disputes effectively.”
Real estate projects, construction operations and infrastructure works involve numerous stakeholders and depend on the precise coordination of technical, contractual and financial obligations. When a dispute arises, it may lead to work stoppages, significant additional costs, a loss in the value of the asset or difficulties in its operation. Real estate litigation therefore plays an essential role in protecting the parties’ rights and ensuring the continuity of projects. Our Real Estate Litigation team advises international architectural firms, property developers established in the Benelux, real estate investment and management companies, as well as buyers and sellers involved in complex real estate projects.
We act in disputes relating to the financing of real estate projects, the award of public contracts, construction defects and non-compliance, contractual breaches, delegations of authority and conflicts of interest. Our assistance may also extend to disputes between shareholders within real estate investment structures. We assist our clients from the pre-litigation stage, including with the preservation of evidence and the conduct of expert proceedings, and represent them before the competent courts through to the enforcement of judgments in domestic and cross-border matters.
Real estate litigation requires a detailed analysis of the contractual documentation, the progress of the project and the respective responsibilities of each stakeholder. Our team combines legal analysis with an understanding of the technical aspects of the matter and coordinates the experts, architects, engineers and advisers involved in order to develop a coherent strategy at every stage of the dispute.
