Confidence in the financial system depends on the security of transactions, compliance with contractual obligations and the effectiveness of guarantee and security mechanisms. In Luxembourg, whose economy is closely connected to banking activities, investment funds and cross-border financial services, disputes in this area can have significant consequences for the assets, reputation and business continuity of the parties concerned. Our Banking and Finance Litigation team advises banks, financial institutions, investment funds, financial technology companies and venture capital firms established or operating in Luxembourg and internationally.
We become involved from the pre-litigation stage, assessing risks, managing crisis situations and negotiating settlement agreements. We also assist our clients in investigations, sanction proceedings and disputes involving the Luxembourg financial sector supervisory authority (CSSF), including matters governed by the regulations applicable to alternative investment fund managers, undertakings for collective investment in transferable securities (UCITS) and specialised investment funds. We represent our clients before the Luxembourg courts and coordinate proceedings where a dispute involves multiple jurisdictions.
Our team combines extensive litigation experience with an in-depth understanding of Luxembourg financial structures and mechanisms. We act in disputes relating to credit transactions, fraud, the enforcement of guarantees and security interests, as well as banking disputes arising from shareholder conflicts. We also have substantial experience in obtaining protective measures, including attachment orders and European Account Preservation Orders.
